Who can submit a family-sponsored visa application?

U.S. Citizens, and sometimes Legal Permanent Residents/Green Card holders, can submit petitions for their spouses and minor children so they can obtain a green card. Please remember that some immigrate without a quota and others have to wait for a place.  

The following family members of a U.S. Citizen are eligible to immigrate without a quota:

  • Children under the age of 21
  • Spouses
  • Parents of U.S. Citizens when the petitioner is 21 years old or older

The following family members of a U.S. Citizen or Legal Permanent Resident are eligible to immigrate with a quota:

  • Married children and children over the age of 21 of a U.S. citizen parent
  • Spouses and children under the age of 21 of a Legal Permanent Resident
  • Children over the age of 21 of a Legal Permanent Resident
  • Brothers of U.S. Citizens

What is the process for applying for a family-sponsored visa?

Applying for Legal Permanent Status can take many months and in many cases years.
